TERMS AND CONDITIONS

Definitions


“Props” means the items hired out by the owner to the Hirer. “Hirer” means any person who requests the Owner to hire props to it, including its employees and agents. “Owner means Palace Props, its employees and agents. ‘Terms’ mean these terms and conditions.

Force Majeure

If either party is prevented from performing any portion of the agreement by causes beyond its control including without limitation, labour disputes ,civil commotion, war, governmental regulations of controls, casualty, inability to obtain materials or services or acts of god, such defaulting party will be excused from performance ( except for payment obligations) for the period of delay and for a reasonable time thereafter.

Cancellation

If the client decides to withdraw from the event for any reason once the agreement has been signed all charges will be payable

Insurance

Insurance is not covered by palace Props P/L .The hirer is responsible in maintaining all appropriate policies of insurance, covering liability , property and casualty insurances in amounts necessary to fully protect the owner and the prop equipment against all claims, loss or damage.

Assumptions

The client will advise Palace Props of any restrictions placed upon them fulfilling their work by management policies e.g. entry & exit times, admission points for props, loading restrictions etc.

Intellectual Property

All Intellectual Property developed by Palace Props will remain the property of Palace Props unless clearly otherwise specified. Any copyright on conceptual or final drawings are the property of Palace props and no part of these drawings can be reproduced, produced, stored or transmitted in any form without the written permission of Palace Props. No part of any proposal can be used without consent to obtain similar services nor passed or produced off under another entity. Legal action will be taken against any infringement.

Loss of or Damage to Equipment

If any of the Props are lost or damaged the hirer must immediately notify the owner. The hirer without limitation is liable for the following; 1) Any costs incurred by the owner in replacing or repairing the Props; 2) Hire charges for the props until the props are repaired or replaced;3) Any costs incurred or loss suffered by the Owner as a result of damage or loss to the Props.

Quote

The quote for the Prop hire is for one use only, unless otherwise consented. The hirer shall not remove the hired Props or any part thereof from the situation and position of its installation without the consent from the Owner.

Hirer’s obligation

The Hirer will take full responsibility for the Props hired, from the time of its delivery until collection by or return to the Owner. The Hirer will assume the risk of and indemnity and hold the Owner harmless from and against any and all property damage and personal injury. The hirer shall maintain at its expense liability, property and casualty insurance coverage in an amount necessary to fully protect the Owner and the Props against all claims, loss or damage of whatever nature or type. The Owner shall not be liable for any loss or damage caused to any person, property, animal or things whatsoever arising from the use of the Props hereby hired and the Hirer indemnifies the Owner in respect to any claims for such loss or damage.
